Transport of healthcare waste moves enormous quantities within European Union every year and is regulated by European and international legislation on the transport of hazardous goods, according to the classification established internationally by UNO. From a legal point of view, two international instruments have been incorporated in European Law to regulate this sector.
This article analyses the main characteristics of the legal system set up to transport hazardous healthcare waste by road within the European Union. It is based mainly on the “European Agreement on Transport of Dangerous Goods by Road” (ADR) and on the „Basel Convention on the Control of Transboundary Movements of Hazardous Waste and their Disposal“, which have been incorporated to European and Members‘ States law. The article explains how in practice transfers between Spain and Portugal function and the effective working of the whole system, even though the administrative divisions of Spain complicate the system.
