Die Notwendigkeit einer Verbandsklage im Klimaschutzrecht
Univ.-Prof. Mag. Dr. Erika Wagner
The following article demonstrates the need to establish collective actions in Austrian civil procedure law in connection with so-called climate claims. Collective actions of non- overnmental organisations (NGOs), which devote themselves to the protection of the environment, have so far not been enforced on a legal level in Austria. Treaty congestion in international environmental lawhas led to some confusion regarding the coordination of multilateral environmental agreements aswell aswith regard to the harmonization of norms across treaties. In this paper, the Wadden Sea serves as an example to illustrate the multilayered protection a “protected area” in international environmental law can enjoy based on the parallel application of several environmental treaties to one single protected area.
