The Alps have a high importance for European and worldwide biodiversity. Due to the small-scale coexistence of natural regions and anthropogenically created cultural landscapes, the Alps offer a large variety of habitats. However, this diversity is threatened by a number of factors; inter alia, there has been a change in the agricultural use of the alpine sites in recent decades.
While modern and intensive forms of land use lead to an overuse of high-yield areas, regions that are difficult to access are becoming increasingly abandoned. Without a sustainable use, the agricultural habitats will be permanently destroyed and biological diversity will decline. In order to ensure an adapted form of mountain farming in the Alps, appropriate framework regulations and financial support systems for farmers are needed. This report presents the legal fundamentals for the preservation of this sustainable mountain farming at various levels of legislation; we examined international (Agenda 21 of the United Nations, Agreement on Agriculture of theWorld Trade Organization and in particular the Alpine Convention with the protocol Mountain Farming), European (Common Agricultural Policy of the European Union) and national respectively regional (German agricultural law and the support system of the federal state of Bavaria) regulatory frameworks.

Rechte der Natur oder Rechte für die Natur in der EU?
© Lexxion Verlagsgesellschaft mbH (6/2025)
An ecocentric concept of separate, enforceable rights of nature for the EU, as has already been enshrined in positive law for the Mar Menor in Spain, offers some advantages for reducing the considerable deficits in environmental protection, but also encounters legal and political limits.
