In April 2004 the EU legislative bodies finally adopted the EU Environmental Liability Directive 2004/35/EC thus putting an end to a controversial legislation process.
The definition of environmental damage comprises water pollution and includes land contamination only when it causes serious harm to human health. Damage to biodiversity is restricted to sites and species protected under community law and national law thus leaving 85% of the territory out in the cold. Claiming the polluter pays principle“ enshrined in art. 174 EU-Treaty, it establishes a framework for prevention and restoration of environmental damages. Yet given the vast array of loopholes such as state of the art defense“ and permit defense“ it remains to be seen, whether this ambitious aspiration can be met. A comprehensive ecological clean-up will also be thwarted by the omission of any retrospective rules. The directive establishes a public law“ regime as opposed to the originally intended civil law one. So it lies primarily with the competent authority to require the operators to carry out the necessary measures and recover the costs, although as a remedy of last resort, individuals and environmental groups may request the competent authority to take action and even challenge declining authorities before the courts. Nevertheless the new directive represents a welcome landmark towards the internalisation of to date external ecological costs.

Forming Consortia for REACH Registration: Contractual and Competition Law Issues

In order to reduce costs for industry and authorities, the Commission’s proposal for a REACH-Regulation of 29 October 2003 strongly supports the forming of consortia for the registration of about 30,000 substances subject to registration requirements. This article examines contractual issues to be observed when forming and operating consortia based on the REACH Proposal.
